Terms of Service

1. The service

Poruchko is an online service for sellers who sell live on TikTok LIVE. It helps you record who bought what, create orders, print labels and send parcels by courier.

By signing up you accept these Terms and the Privacy Policy.

2. Account and who may sign up

• The service is for businesses and self-employed sellers who use Poruchko for their trade. It is not for consumers using it for personal purposes.
• You must be of legal age and entitled to act on behalf of the shop.
• You give accurate details and keep your password safe. You are responsible for actions taken with your account, including by staff you give access to.

3. Free trial and payment

• The free trial lasts 10 days and needs no card.
• After it the service is paid, on monthly plans based on your monthly sales.
• Prices are without VAT.
• We invoice once a month.
• If an invoice is not paid, we may limit some features, and later the account becomes read-only. Your data stays available to view, and access is restored once you pay.

We show the current plans and prices in the app before you accept them.

4. Your buyers' data

You are the controller of your buyers' data and we are the processor, as described in the Privacy Policy. You are responsible for having a lawful basis to collect and use this data, for informing your buyers, and for using the service lawfully.

Do not use Poruchko for illegal goods, fraud, spam or harassment, and do not enter data you have no right to process.

5. TikTok and other third-party services

TikTok is a third-party service. Poruchko is not affiliated with TikTok and is not endorsed by TikTok. Access to live comments depends on third-party services and on TikTok's rules, which can change. We do not guarantee that the connection will always work or that every comment will be captured.

The same applies to couriers and other third-party services. Their terms and systems apply.

6. Availability

We try to keep the service running all the time, but we do not guarantee it. There may be maintenance windows and outages. We recommend checking important parcels and amounts.

7. Limitation of liability

To the extent the law allows, we are not liable for lost profit, lost sales, errors in comments or parcels caused by third-party services, or indirect damage. Our total liability to you for one year does not exceed the amount you paid for the service in the previous 12 months. These limits do not affect liability that cannot be excluded by law.

8. Closing the account

• You can ask to close your shop at any time.
• Personal data is erased 30 days after the request, and orders and amounts stay, anonymised.
• We may suspend or close an account for a breach of these terms or abuse, and we will tell you beforehand when possible.
• Unpaid amounts remain due.

9. Changes to the terms

We may change these terms. We will tell you by email before the change takes effect. If you keep using the service after that, you accept the new terms. If you do not accept them, you can close your account.

10. Governing law and disputes

These terms are governed by Bulgarian law. Disputes are decided by the competent Bulgarian court.
